etla Acceptable Use Policy

This Policy applies to the use of etla by the Customer and Authorized Users, and forms part of the etla Terms of Service.

1. Basic Principles

The Customer must use the Service in a lawful, safe manner that respects the rights of others. The Customer is responsible for the conduct of its Authorized Users, any AI agents it configures, and any person using the Service on the Customer’s behalf.

2. Illegal or Rights-Infringing Use

You must not use the Service for any of the following purposes or in any of the following manners:

  1. Violating any law, court order, or administrative regulation
  2. Infringing intellectual property rights, privacy, publicity rights, reputation, trade secrets, or other rights
  3. Offering, promoting, or brokering illegal goods, services, or transactions
  4. Obtaining or processing personal data, communications content, or confidential information without the necessary rights, notice, consent, or legal basis

3. Harmful, Fraudulent, or Deceptive Use

You must not use the Service for any of the following purposes or in any of the following manners:

  1. Fraud, phishing, impersonation, circumventing identity verification, or stealing credentials
  2. Presenting AI-generated responses, synthetic voice, or synthetic content as human-created for the purpose of deceiving an affected individual
  3. Facilitating threats, harassment, stalking, discrimination, exploitation, or serious harm to others
  4. Improperly interfering with an election or other civic process using false or misleading information
  5. Specifically facilitating or carrying out self-harm, violence, child sexual exploitation, or other serious harm

4. Cybersecurity and Unauthorized System Use

You must not:

  1. Distribute malware, steal credentials, exploit vulnerabilities, or gain unauthorized access to third-party systems
  2. Conduct security testing, penetration testing, scanning, or load testing without authorization
  3. Circumvent rate limits, access controls, safety features, usage limits, or monitoring
  4. Interfere with the normal operation of the Service or third-party services
  5. Extract or reverse engineer the Service’s source code, models, algorithms, or non-public technical configuration, except as expressly permitted by applicable law or with our prior written permission

5. Decisions with Material Impact

Except where the Customer has established review, human oversight, and a means of appeal appropriate under applicable law, the Customer must not base the following decisions solely on AI output:

  1. Hiring, termination, performance evaluation, placement, promotion, or other employment decisions
  2. Decisions regarding access to credit, lending, insurance, housing, education, or public benefits
  3. Professional judgments regarding healthcare, diagnosis, treatment, or legal rights and obligations
  4. Decisions producing legal effects or similarly significant impact on an individual
  5. Controls directly affecting the safety of human life, body, or critical equipment

Except where we have expressly approved such use in an Order and the applicable law and additional conditions are satisfied, the Service must not be used for the primary purpose of biometric identification, emotion recognition, employee monitoring, or social scoring.

6. Data and Privacy

  1. Special categories of personal data, special care-required personal information (as defined under the APPI), children’s data, biometric data, health information, government-issued identification numbers, or payment card information may be input only where expressly agreed in an Order.
  2. The Customer must not input personal data or confidential information into prompts, knowledge sources, or logs beyond what is necessary for business purposes.
  3. The Customer shall configure access permissions and data sources so that data is not improperly shared between users with different levels of authorization.

7. Communications and Outbound Contact

The Customer must not:

  1. Engage in sales, advertising, solicitation, or other regulated communications without the necessary consent or legal basis
  2. Spoof caller ID, sender information, or the identity or purpose of the communicating party
  3. Disregard a recipient’s opt-out or refusal of contact
  4. Conduct recording, transcription, or communications analysis without the notice or consent required by applicable law
  5. Use the Service as a means of emergency communication, life-sustaining communication, or the sole critical means of contact

8. Fairness and Human Oversight

  1. The Customer shall assess the accuracy, fairness, and data quality necessary in light of the purpose of use.
  2. Where AI output is used for material decisions, the Customer shall establish meaningful human oversight enabling a responsible person to modify or reject the output.
  3. The Customer shall periodically review the basis for the output, the adequacy of the input data, and the impact on affected individuals.

9. Our Response

  1. We may request information and remediation from the Customer to investigate a suspected or actual violation of this Policy.
  2. Depending on the urgency, severity, and likelihood of recurrence, we may remove the relevant input or output, restrict features, suspend the account, or terminate the Agreement.
  3. Except in urgent cases, we will make reasonable efforts to notify the Customer of the reason and the means of remediation.
  4. Where illegal conduct or serious harm to a third party is suspected, we may, in accordance with applicable law, report the matter to the relevant authorities or preserve the necessary information.
